The Ombudsman Program investigates and works to resolve complaints made by or on behalf of residents of nursing homes, adult care homes, and family care homes, and advocates to protect resident rights. Ombudsmen can visit facilities, talk with residents and staff, help mediate disputes, and educate residents and families about their rights -- but they act only with the resident's consent and do not have enforcement or licensing authority.
How this actually works
The Ombudsman's role is fundamentally about advocacy and resident-directed problem-solving rather than regulatory enforcement -- a distinction families sometimes find frustrating when they want a facility punished for a violation. If a family believes a facility itself needs to be formally investigated for a licensing violation or safety deficiency, that complaint generally goes to NC DHSR's Complaint Intake Unit (1-800-624-3004), while suspected abuse or neglect of an individual is reported to the county DSS Adult Protective Services office. The Ombudsman instead works directly with the resident -- listening to their concerns, explaining their rights, and helping negotiate a resolution with facility staff or management, always centered on what the resident wants, not what a family member wants on the resident's behalf. This resident-centered approach is a core value of the Ombudsman Program nationally, not unique to North Carolina, and it's part of why the consent rule exists.
